Tasks and powers of the management advisory board 

According to Section 29 (1), the appointment of an administrative advisory board is not mandatory. However, if an advisory board is appointed, it usually consists of three members and is determined by majority resolution. However, a different composition is permissible. The duration of the appointment and the reimbursement of expenses may also be determined by majority resolution.

Audit of the business plan and the annual financial statement

The primary duty of the management advisory board is to support and monitor the manager. The tasks of the advisory board include formally reviewing the business plan and the annual financial statement and providing an opinion. This opinion can be given verbally or in writing. However, it is important to note that the management advisory board has no rights to issue instructions to the manager.

Other tasks of the management advisory board

Apart from signing the minutes and convening an owners' meeting (section 24(3)(6)), the management advisory board has no other mandatory duties. However, the advisory board may assist the administrator in an advisory capacity in the performance of its duties and, if necessary, make suggestions for improving the administration activities.

Misunderstandings regarding the powers of the management advisory board

A common misunderstanding is that the management advisory board has rights to issue instructions to the administrator. However, this is not the case. The advisory board merely has the task of supporting and monitoring the administrator. However, the administrator remains responsible for the management activities and the implementation of the resolutions of the owners' meeting.
